You must be at least eighteen (18) years old and legally capable of entering into a binding agreement to use the Website.
By using the Website, you represent and warrant that:
Five Star Claims Adjusting is a Florida public adjusting business that assists insureds and claimants with insurance claims, subject to applicable licensing requirements, Florida law, and a separately executed Public Adjuster Contract.
A public adjuster works for and is compensated by the insured or claimant. A public adjuster is not an employee or representative of the insurance company.
Our public adjusting services may include, when authorized by a valid written contract:
The services provided in any particular matter will be determined by the executed Public Adjuster Contract and the circumstances of that claim.
Accessing the Website does not create a public adjuster-client, fiduciary, advisory, or other professional relationship between you and Five Star Claims Adjusting.
None of the following actions, standing alone, creates a public adjuster-client relationship:
A public adjuster-client relationship is created only after a written Public Adjuster Contract has been properly completed and executed by the required parties in accordance with applicable law.
Five Star Claims Adjusting is not obligated to accept any person or claim for representation merely because information was submitted through the Website.
If Five Star Claims Adjusting accepts a claim for representation, the professional relationship will be governed by a separate written Public Adjuster Contract, required disclosures, authorizations, and any properly executed written amendments.
These Website Terms do not establish:
If these Website Terms conflict with an executed Public Adjuster Contract, the executed Public Adjuster Contract will control with respect to the professional services and insurance claim covered by that agreement.
Website content is provided for general educational and informational purposes only. It is not intended to provide a complete analysis of any insurance policy, loss, claim, coverage issue, or legal question.
Insurance policies, endorsements, exclusions, deductibles, limitations, claim procedures, and applicable laws vary. Information that may be relevant to one loss or insurance policy may not apply to another.
You should not take or refrain from taking action regarding an insurance claim solely because of information provided on the Website.
Five Star Claims Adjusting provides public adjusting services within the scope permitted by applicable law. We are not acting as your attorney, engineer, architect, accountant, tax adviser, financial adviser, building contractor, remediation company, or insurance company.
Nothing on the Website constitutes:

Nothing on the Website is a promise or guarantee of coverage, payment, settlement, timing, or any other claim outcome.
Any preliminary estimate, claim evaluation, damage description, repair scope, potential value, or opinion discussed before execution of a Public Adjuster Contract is informational only.

Website use and communications with Five Star Claims Adjusting do not relieve you of any duty to protect property from further damage, take reasonable emergency measures, preserve evidence, comply with your insurance policy, report a loss, cooperate with an insurer, or meet any contractual or legal deadline.
You remain responsible for taking reasonable steps appropriate to your circumstances and obtaining emergency assistance when needed.
In an emergency involving immediate threats to life, safety, or property, contact emergency services or an appropriately qualified emergency-service provider.
Insurance policies and Florida law may impose deadlines for reporting losses, submitting documentation, completing repairs, providing notices, filing supplemental claims, initiating dispute-resolution procedures, or taking legal action.

To the fullest extent permitted by law, the Website and its content are provided on an “as is” and “as available” basis.
Five Star Claims Adjusting disclaims all express and implied warranties concerning the Website, including implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, completeness, availability, security, and reliability.
We do not warrant that:
Nothing in this section excludes a warranty or right that cannot lawfully be excluded.
To the fullest extent permitted by law, Five Star Claims Adjusting and its owners, managers, officers, employees, public adjusters, apprentices, contractors, affiliates, agents, and representatives will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages arising from or related to your use of, or inability to use, the Website.
This includes damages arising from:
To the fullest extent permitted by law, Five Star Claims Adjusting’s aggregate liability arising solely from your use of the Website will not exceed the greater of:
This Website limitation does not replace or modify any liability provision contained in an executed Public Adjuster Contract.
Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, the limitation will apply only to the maximum extent permitted by law.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Five Star Claims Adjusting and its owners, managers, officers, employees, public adjusters, apprentices, contractors, affiliates, agents, and representatives from claims, liabilities, judgments, losses, damages, penalties, costs, and reasonable legal fees arising from or related to:

We may suspend, restrict, or terminate your access to the Website, with or without prior notice, if we reasonably believe that you:
Termination of Website access does not terminate or modify an executed Public Adjuster Contract. Termination of a professional engagement must occur in accordance with that contract and applicable law.
These Terms and any dispute arising solely from the use of the Website will be governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Before filing a legal action concerning the Website, you agree to provide written notice describing the dispute and allow Five Star Claims Adjusting thirty (30) days to attempt to resolve the matter informally.
The notice should include your name, contact information, a description of the issue, the relevant dates, and the relief requested.
This informal-resolution requirement does not prevent either party from seeking emergency injunctive relief when reasonably necessary to prevent immediate harm, unauthorized access, or intellectual-property infringement.
Subject to any applicable law requiring otherwise, a legal proceeding arising solely from these Website Terms must be brought in a court of competent jurisdiction located in Orange County, Florida.
A venue or dispute provision contained in an executed Public Adjuster Contract will control disputes arising from the professional services provided under that contract.
Our failure or delay in enforcing any provision of these Terms does not waive our right to enforce that provision or any other provision in the future.
A waiver is effective only when stated in writing by an authorized representative of Five Star Claims Adjusting.
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted, limited, or modified to reflect its original purpose to the fullest extent permitted by law.
If the provision cannot be appropriately modified, it will be severed, and the remaining provisions will remain in full force and effect.
You may not assign, delegate, sublicense, or transfer your rights or obligations under these Terms without our prior written consent.
Five Star Claims Adjusting may assign or transfer these Terms in connection with a merger, acquisition, restructuring, sale of assets, change in control, or other lawful business transaction.
Section headings are included for convenience and do not limit the meaning of any provision.
Words such as “including” and “include” mean “including without limitation.” References to the singular include the plural when the context reasonably requires, and references to the plural include the singular.
These Terms, together with the Privacy Policy, Cookie Policy, and any other policies expressly incorporated by reference, constitute the entire agreement between you and Five Star Claims Adjusting concerning your use of the Website.
These Terms supersede prior website-related statements or communications concerning the same subject matter.
These Terms do not supersede or replace a properly executed Public Adjuster Contract, claim authorization, disclosure form, or written amendment governing professional public adjusting services.
We may revise these Terms from time to time to reflect changes in the Website, our business practices, or applicable law.
When changes are made, we will update the “Last Updated” date displayed at the top of this page. Unless otherwise stated, revised Terms become effective when posted.
